Sáng ngày 24/12/2009, Houston Chronicle viết một bài trên trang nhất về nghị viên vừa đắc cử Al Hoàng tức luật sư Hoàng Duy Hùng. Tôi quen biết nghị viên đắc cử Al Hoàng đã gần 3 thập niên nên tôi cho rằng ông chẳng làm gì sai.

Thứ nhất, trong hồ sơ Bộ Giao Thông Tiểu Bang Texas, ngày 6 tháng 5 năm 2008, Al Hoàng đã đổi địa chỉ về 4403 Bugle Ln và chỉ định đây là nơi cư trú của ông. Như vậy là 19 tháng trước ngày bầu cử, đúng theo quy định. Không có luật nào bắt buộc một người phải mua nhà mới trở thành cư dân tại đây. Khi đổi địa chỉ bằng lái, ông cũng thông báo với Bộ Ghi Danh Bầu Cử, nhưng không biết vì lý do nào, có thể vì thư thất lạc, họ đã không cập nhật hóa chi tiết này trong trang nhà mạng lưới của họ để rồi năm sau chính Al Hoàng đích thân tới nơi yêu cầu thì họ mới làm.

Thứ hai, tôi có sưu lục hồ sơ thì không hề thấy Al Hoàng ký giấy xin homestead exemption cho căn nhà Westpark, Bugle hay các tài sản khác ở Galveston. Rõ rang, ông không hề gian lận trong việc đóng thuế tài sản đất đai của ông.

Thứ ba, về việc phảI nêu ra nghề nghiệp của những ủng hộ viên đã đóng góp từ $500 trở lên, Bộ Luật Tranh Cử chỉ bắt buộc ở cấp Liên Bang và các chức vụ tiểu bang, không bắt buộc các chức vụ thành phố. Nguyên văn của Bộ Luật như sau:

Candidates for and holders of statewide offices in the executive branch and candidates for and holders of legislative offices must disclose the principal occupation or job of an individual from whom the candidate or officeholder has accepted contributions (including pledges) of $500 or more during the reporting period. In other circumstances, filers are not required to report this information but may do so.

Thêm vào đó, nếu có sự sơ xót nào, Al Hoàng có quyền nộp hồ sơ bổ khuyết vào ngày 15 tháng Giêng 2010.

Ai cũng biết Houston Chronicle yểm trợ cho đối thủ Mike Laster tối đa, viết nhiều bài ca tụng Mike Laster và đã nhiều lần tìm bằng mọi cách hạ bệ Al Hoàng. Houston Chronicle còn tiên đoán Mike Laster thắng cử. Nhưng kết quả không y như Houston Chronicle muốn.

Tôi đồng ý với ông Jared Woodfill, Chủ Tịch Đảng Cộng Hòa của Hạt Harris đó là “chum nho chua từ những người ủng hộ đối phương” và đã thất cử. Chúng ta hãy nhìn đến tương lai để xây dựng thành phố của chúng ta.

On December 24, 2009, Houston Chronicle wrote an article on the first page about to councilman-elect Al Hoang. With due respect to Houston Chronicle’s writing, but I have a different perspective. As a personal friend of Al Hoang for almost 3 decades, I believe Councilman-elect Al Hoang did nothing wrong.

First, the record of Texas Department of Transportation reflects that on or about May 6, 2008, Al Hoang changed his address to 4403 Bugle Ln and designated as his residence. That would be 19 months before the election. No law requires a person to purchase the property in order to become a resident. Later on, as reflected in Harris County Appraisal District, Councilman-elect Al Hoang purchased that property. To my knowledge, on the day filing the change of address, Mr. Hoang also filed with the Harris County Voters Registration Department, and thought it was already in the system, but someway somehow the Department did not change it maybe because of oversight and/or it was not reached.

Second, I’ve searched and I did not see any record showing that Al Hoang signed any document designating the properties on Westpark, Bugle, and other properties in Galveston County as his homestead exemption. Obviously, he did not cheat on his property taxes.

Third, about the occupation of the donors of more that $500, the code does not required candidates to be reported at the municipal level. Form C/OH instructions Guide #9 stated the following:

Candidates for and holders of statewide offices in the executive branch and candidates for and holders of legislative offices must disclose the principal occupation or job of an individual from whom the candidate or officeholder has accepted contributions (including pledges) of $500 or more during the reporting period. In other circumstances, filers are not required to report this information but may do so.

Additionally, if there is any error, Al Hoang can file the Amendments on January 15, 2009.

I agree with Harris County Republican Chairman Jared Woodfill that “sour grapes from someone who supported the opposition” and lost the election. Let’s go forward for the better of our City.
